These terms and conditions constitute a contract between My Home Limited ('My Home') and you the Customer once you register to use the MYHOME2LET MOBILE services as outlined below. By registering with (see below) and using MYHOME2LET MOBILE you acknowledge that these terms and conditions form a contract between My Home and you the Customer.

Acceptance of these Terms and Conditions
The following terms and conditions affect your legal rights and you should read them carefully. By accepting the terms and conditions you provide an irrecoverable authority to My Home and an indemnity, which authority and indemnity are set out at Clauses 10 and 11 below.
These terms and conditions may be amended from time to time by My Home without notice to you. By accepting these terms and conditions, you also agree to re-visit these terms and conditions regularly in order to become acquainted with any amendments, additions or changes of any kind which may be made from time to time.

How to Use the MyHome2Let Mobile WAP site
5.1 Search for a property
When searching for property on the site, you’ll enter the same criteria as you would on the website. The interface will differ slightly for each phone, so users should consult the user guide that came with their phone if difficulties are experienced in browsing.
5.2 Phone the Estate Agent
The brochures on the WAP site contain a button called “Dial Now”. By clicking on this button, the phone automatically dials the relevant estate agent. In this way, customer’s no longer have to write down the phone number before closing their WAP session, and dialing the number.
5.3 Request a Callback
Using this button on the property brochure, customers can access a short form that can be used to request a callback from the estate agent regarding that brochure.
5.4 Send a Brochure
Using this facility, customers can send the brochure they’re viewing to a mobile phone. Customers should ensure that the recipient has already enabled data services on their phone.
Customers simply click on the link, enter the recipient’s number, a message, and click send.
In some cases, customers may need to register a password and send “MyHome2Let confirm” to 51444, before the message will be sent. This depends on the settings and rules applied by the network.

Customer Acknowledgements
8.1 Consent to Identification You consent to have your mobile phone number and/or uid made available as identification for use of this service to My Home, it's agents and contractors. 8.2 Consent to Location Verification You consent to having your location identified via your mobile handset for the purposes of the provision of the MYHOME2LET MOBILE service. 8.3 Charges for the Service While browsing the site and searching for property is free of charges from MyHome.ie, your network will charge you to browse sites using your mobile handset. You should refer to your network for details.
You understand and agree that by using the service you will be charged at Premium Rates for some services as described and in accordance with the scale of charges outlined herein for the relevant information received via the MYHOME2LET MOBILE service. 8.4 MyHome2Let.ie is not an emergency or safety service You acknowledge that MYHOME2LET MOBILE is not an emergency or safety service, and should not be used or attempt to be used as such under any circumstances.

Use of MYHOME2LET MOBILE for unwarranted or illegal purposes
9.1 Fraudulent or Illegal Use Any use of MYHOME2LET MOBILE for any fraudulent, illegal, or criminal purpose or any other purpose which is brought to the attention of My Home, such purpose including but not limited to tampering, hacking, modifying, accessing data without consent, having unauthorised access to other MYHOME2LET MOBILE customer's personal details (including their location at any given time), corrupting the security and functionality of MYHOME2LET MOBILE network or any of its customers will result in the termination of the accounts of all participating parties of the Acts referred to above and will result in My Home taking appropriate civil legal action and/or immediate notification of An Garda Siochana, Garda Bureau of Fraud Investigation (Computer Fraud Section) Harcourt Square, Dublin 2.

Exclusion Warranties and Liability
10.1 No Representations as to Accuracy or Reliability My Home does not warrant or make any representations regarding the content or use or the results of the use of MYHOME2LET MOBILE or content contained therein in terms of its accuracy or reliability. 10.2 Loss and/or Liability arising My Home is not liable for any injury, loss, claim, damage or expense or any consequential damage or incidental damage of any kind arising from or in connection with any customers access to or use of MYHOME2LET MOBILE and of any service or goods provided by any retailer, merchant or trader whose details appear in or as part of the content on MYHOME2LET MOBILE, any material or any goods, materials or services available therefrom, whether based on contract, tort and whether negligent or otherwise, even if My Home has been advised of the possibility of such damage. In the event that exclusion of liability is held by a Court of competent jurisdiction to be unlawful, that liability may be lawfully limited, My Home's aggregate total liability to any Customer for all such damages and losses shall be limited to the amount paid by the Customer if any for accessing or using MYHOME2LET MOBILE. My Home shall have no liability in respect of any damage occurring both material and personal arising from breach of contract, breach of duty, including breach of statutory duty and/or negligence of any service or goods provider. 10.3 Third Party Provision of Content Customer acknowledges that MYHOME2LET MOBILE and the content of the MYHOME2LET MOBILE are provided by third parties and is provided to Customers 'as is'. My Home is not responsible and shall incur no liability for any content which is or is not provided or otherwise made available as part of the MYHOME2LET MOBILE, nor for the monitoring or editing of the said content. My Home shall have no liability in respect of any loss (whether direct, indirect, special, incidental or consequential), damage, injury, or costs incurred by the Customer, nor with respect to any action or proceeding brought by or against a Customer, in connection with the content of MYHOME2LET MOBILE or with any Customer's use of MYHOME2LET MOBILE. 10.4 Continuity of Service While My Home will use reasonable efforts to make the MYHOME2LET MOBILE service continuously available, due to the nature of mobile telecommunications, it is impossible to provide a fault-free service. My Home is not liable to Customers for any direct, indirect, special, incidental or consequential loss (including loss of profit) (whether or not foreseeable) suffered as a result of the network or MYHOME2LET MOBILE not being operational, or for any failure, delay, suspension, restriction or interruption of the network or MYHOME2LET MOBILE.

Operation of MYHOME2LET MOBILE
11.1 Incorrect or unauthorized information My Home shall not be responsible for claims by third parties due to the provision of incorrect or unauthorised information via the MYHOME2LET MOBILE service. 11.2 Termination of Access My Home may at its sole discretion terminate Customers access to MYHOME2LET MOBILE and at any time. My Home may also be required to terminate Customers access to the network at any time by O2 Ireland or Vodafone Ireland.

Indemnity and Waiver
You agree to indemnify and hold harmless My Home and its successors, assigns, affiliates, officers, directors and employees for any liability, loss, damage and expense, claims whether present or future (including reasonable fees on a solicitor and own client basis) or demand whatsoever relating to or arising from the following:
(a) any misuse of MYHOME2LET MOBILE;
(b) any claim against My Home arising from any illegal, criminal, offensive, or inappropriate use of MYHOME2LET MOBILE.

Data Protection
13.1 Provision of Personal Information By using MYHOME2LET MOBILE, you will automatically be providing information personal to you, including without limitation your mobile phone number and your current location (Personal Data). 13.2 Use of Personal Information Your Personal Data will be used by My Home in order to allow you access to the MYHOME2LET MOBILE service and for the consequent billing of charges to you. 13.3 Processing of Location Information By using MYHOME2LET MOBILE, details of the location of your Handset, and requests from your Handset for details of facilities near to that location shall be processed on a central server operated by My Home and/or its agents.. No record is kept of this information. 13.4 Unsubscribe You will be required to agree to these terms and conditions on the first occasion you use the service. You will not be sent unsolicited information by My Home, its agents or any third parties at any time. However, should you wish to specifically ‘Unsubscribe' from the service and thereby have your personal data removed from MYHOME2LET MOBILE you may do so by sending a text to 51444 containing the phrase: STOP MYHOME2LET
